These terms are set out under which Seedflex Capital Sdn. Bhd. (Registration No. 202301048212 (1542126-P)) (“Seedflex”) will provide the services (“Services”) to you on https://www.seedflex.com (the “Platform”). 1.3 "Platform" means https://www.seedflex.com or the web portal provided by Seedflex for users to log in and access the Services made available at https://app.seedflex.com/ (or such sub-domain or additional or replacement website(s)) that allows you to access the Services, and includes any mobile or desktop application through which the Platform may be accessed.

By accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not access the Platform.
3. Use of the Platform

4.4 Repayment: Advances must be repaid in accordance with the terms and conditions provided at the time of the advance.
5. Intellectual Property
5.1 Ownership: All content on the Platform, including but not limited to text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of Seedflex or its content suppliers and is protected by copyright laws.
5.2 License: You are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the Platform and its content for personal, non-commercial use only.
6. User Conduct
6.1 Compliance: You agree to comply with all applicable laws, rules, and regulations when using the Platform.
6.2 Prohibited Activities: You agree not to engage in any of the following activities:
a. Violating any laws or regulations;
b. Impersonating any person or entity, or falsely stating or otherwise misrepresenting your affiliation with a person or entity;
c. Interfering with or disrupting the operation of the Platform or servers or networks connected to the Platform;
d. Breaching or attempting to breach the security of the Platform;
e. Using the Platform for any purpose that is unlawful or prohibited by these Terms.
7. User Content
7.1 Responsibility: You are solely responsible for any content, including but not limited to text, images, videos, and other materials, that you upload, post, or otherwise make available on the Platform ("User Content").
7.2 Ownership: You retain ownership of your User Content. By uploading, posting, or otherwise making User Content available on the Platform, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with the Platform and our business.
8. Authorization
8.1 Credit Checks: By using the Platform and requesting an advance, you authorize us to conduct credit checks and obtain information from credit bureaus and other sources as necessary to assess your creditworthiness and eligibility for an advance.
8.2 Information Verification: You authorize us to obtain and verify information about you from third parties, including but not limited to identity verification services, financial institutions, and other relevant sources, for the purpose of verifying your identity, assessing your eligibility for an advance, and preventing fraud.
9. Confidentiality
9.1 Protection of Information: We will handle all information obtained in connection with credit checks, information verification, and any other personal or financial information provided by you in accordance with our Privacy Policy.
9.2 Privacy Policy: Our Privacy Policy outlines how we collect, use, disclose, and protect your personal information. By using the Platform, you consent to the collection, use, disclosure, and protection of your personal information as described in our Privacy Policy.
10. Suspension or Termination
10.1 Right to Suspend or Terminate: We reserve the right to suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice.
10.2 Effect of Suspension or Termination: Upon suspension or termination of your access to the Platform, your right to access and use the Platform and any User Content may be terminated immediately, and we may remove or delete any User Content associated with your account.
11. Indemnification
You agree to indemnify, defend, and hold harmless Seedflex and its officers, directors, employees, agents, licensors, and suppliers from and against all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from or relating to your use or misuse of the Platform, your User Content, or your violation of these Terms.

These Terms shall be governed by and construed in accordance with the laws of Malaysia, without regard to its conflict of law principles.
